Terms of Service

The agreement between you and CryptoCard. It covers what the service does, what it costs, what we each owe the other, and how it ends.

1. This agreement

These Terms of Service (the "Terms") govern your use of the CryptoCard website, dashboard, application programming interface and payment cards (together, the "Service"). CryptoCard ("we", "us") operates the Service. By creating an account or using any part of the Service you accept these Terms.

If you do not accept them, do not create an account. If you are using the Service on behalf of a company, you confirm you are authorised to bind it, and "you" means that company.

We may change these Terms. Where a change materially reduces your rights or increases your obligations we will give notice on this page and by email at least 30 days before it takes effect. Continuing to use the Service after that date means you accept the change. If you do not, close your account before the date and spend your remaining balance.

2. Who may open an account

You must be at least 18 years old and have the legal capacity to enter into a contract.

We do not ask for identity documents. That does not remove the conditions below, and by opening an account you confirm that each of them is true and remains true:

  • you are not a resident of, or located in, a jurisdiction subject to comprehensive sanctions;
  • you are not listed on any sanctions list we are required to screen against;
  • the funds you deposit are yours and are of lawful origin;
  • you are not acting on behalf of an undisclosed third party.

One person, one account. Opening several accounts to defeat a limit, a fee or a suspension is a breach of these Terms.

3. Your account and its security

An account is an email address and a password. That address is the only channel we have for you: it receives your 3-D Secure confirmation codes, your password reset links and any notice we are required to send. Keep it current and keep it accessible.

You are responsible for everything done through your account. We strongly recommend enabling two-factor authentication and storing the 10 recovery codes issued when you do.

Understand the consequence of the design. Because we hold no identity information, we cannot verify that a person claiming an account is its holder. If you lose access to your email address, your password and your recovery codes, the account and any balance in it cannot be recovered by any means. This is not a limitation we can waive on request.

If you believe your credentials or an API key have been compromised, act from the dashboard rather than waiting on us: rotating a key takes effect on the very next request, and freezing a card declines every authorisation at once. Both are immediate, both are reversible decisions you control, and both are faster than any message could be.

4. What the Service is — and is not

We issue prepaid payment cards funded by a balance you load with cryptocurrency. The balance is denominated in US dollars.

We are not a bank. Your balance is not a deposit and is not covered by any deposit guarantee or insurance scheme. It is a prepaid balance held for the purpose of funding card payments, on which we pay interest under section 9.

We do not offer investment advice, custody of crypto assets as an investment, exchange services between crypto assets, or lending services to you. Conversion happens once, at the moment a deposit is credited, for the sole purpose of funding your card. The interest described in section 9 is a contractual rate we pay you on a prepaid balance; it is not a return on an investment you have made, and you acquire no interest in any underlying asset.

5. Deposits

You fund your balance by sending cryptocurrency to a deposit address we open for one specific deposit. The deposit screen shows an exact amount, the network, and where applicable a memo or tag.

  • Every deposit is $100 minimum, the first one and every one after it. The maximum is $100,000 per deposit.
  • A 1% fee is deducted from each deposit. It is shown before you confirm.
  • A deposit is credited automatically after one network confirmation.

A deposit address is valid for one deposit and expires. You are responsible for sending the exact amount, on the correct network, including any memo or tag shown. We will make reasonable efforts to reconcile a payment that does not match, and we cannot guarantee recovery of assets sent to an expired address, on the wrong network, or without a required memo.

Cryptocurrency transactions are irreversible. Once broadcast, a payment cannot be recalled by us.

6. Cards

Your first card is issued when your first deposit is credited and is free. Each additional virtual card costs $2, charged to your balance at the moment of issue. You may hold up to 5 cards at a time; deleting one frees a slot. Your default card cannot be deleted.

A physical card costs $15 plus $20 shipping, with priority shipping available for an additional $25. We ship to 184 countries. No name is printed on the card.

Cards are issued on a card network and are subject to that network's rules, which we do not control. A payment may be declined for reasons including insufficient balance, a frozen card, a monthly limit you set, an expired 3-D Secure challenge, or a merchant pre-authorisation exceeding your balance.

You may freeze or delete a card at any time. Freezing declines every authorisation immediately and is reversible.

7. Authorising online payments

When a merchant requests 3-D Secure, we send a six-digit code to your account email address. We do not send codes by SMS and we do not hold a phone number for you.

A challenge expires on its own after a short window. Entering the code, or approving the challenge through the API, authorises the payment. Treat that code exactly as you would a card number.

If your API key carries the 3ds:read and 3ds:write scopes, your own systems can read and resolve challenges. Both scopes are off by default. Enabling them is your decision and your responsibility.

8. Fees

The complete fee schedule:

  • 1% on every deposit.
  • $2 per additional virtual card. The first card is free.
  • $15 for a physical card, plus $20 shipping, plus $25 for priority shipping.
  • No monthly fee, account fee, inactivity fee, or fee to make a payment.

Fees are shown before you confirm an action and appear in your transaction history. A merchant, a network or your own wallet may apply charges we neither set nor receive.

We may change fees with 30 days notice on this page and by email. A change never applies retroactively to a deposit already credited.

9. Interest on your balance

We pay interest on the balance you hold with us. The rate is currently 4% a year, quoted as a nominal annual rate.

It is calculated like this, every day, without any action from you:

  • at 00:00 UTC we take your closing balance for the day that has just ended;
  • we apply the annual rate divided by 365;
  • the result is credited to your spendable balance and appears in your transactions as Interest.

Because each payment joins your balance, the following day is calculated on the larger total. Compounded daily, 4% a year is equivalent to 4.08% APY if you hold a balance for a full year and spend none of it.

Interest is calculated to a fraction of a cent. Any amount below $0.01 is carried forward and paid on the first day the accumulated total reaches one cent, so nothing is lost to rounding. On a balance above $92, a payment lands every day.

There is no minimum balance, no lock-up, no notice period and no penalty for spending. Interest simply follows the balance: spend it to zero and interest stops; top up and it resumes the same day.

The rate is variable. We may change it at any time. Where a change reduces the rate we will publish the new rate on this page and on our homepage at least 14 days before it takes effect. An increase may take effect immediately.

You should understand what this is. Interest is funded by lending and staking the reserve that backs customer balances. It is not cashback — nothing about it depends on your card spending. It is not a bank deposit and carries no deposit guarantee. The activities that fund it carry counterparty, stablecoin and protocol risk, which we bear rather than passing to you: your balance itself remains payable to you in full at any time, and we do not reduce it if those activities underperform. What we can do, and what you are agreeing to, is change the rate for the future on the notice above.

We do not pay interest on a balance while the account is suspended under section 12, and no interest accrues for any day on which the balance is zero.

Interest is paid as a US dollar balance, never as a crypto asset. You are responsible for any tax due on it in your jurisdiction. Because we hold no identity information about you, we do not withhold tax and we do not report interest to any tax authority.

10. The API

An API key acts with the full authority you grant it. Capabilities are separated into scopes; four of them — reading full card numbers and reading or resolving 3-D Secure challenges — are closed until you deliberately open them.

You must keep keys server-side, rotate them if exposed, and stay within 120 requests per minute per key. Automated use that degrades the Service for others may be rate-limited or suspended.

We may change the API. Breaking changes to a stable endpoint will be announced at least 90 days in advance by email to accounts with an active key.

11. What you may not do

You may not use the Service:

  • for anything unlawful in your jurisdiction or in ours;
  • to launder proceeds of crime, finance terrorism, or evade sanctions;
  • to fund transactions involving child sexual abuse material, human trafficking, or the sale of weapons or controlled substances where unlawful;
  • to defraud a merchant, including by disputing a payment you authorised;
  • to resell, rent or share access to a card or an account with a third party;
  • to circumvent a limit, a suspension, or a security control, including by opening additional accounts;
  • to probe, scan or stress the Service other than through the documented API.

Breach of this section is grounds for immediate suspension or closure, and may be reported to the competent authorities.

12. Suspension and closure

We may suspend a card, an API key or an entire account, with or without prior notice where notice would defeat the purpose, if we reasonably believe there is a breach of these Terms, fraud, a security compromise, or a legal obligation requiring it. Where we can tell you why, we will.

You may close your account at any time from Settings. Closure is permanent: cards stop working, history is deleted, and deposit addresses stop being monitored. Spend your balance before you close. A balance does not survive closure and is not refundable afterwards.

We may discontinue the Service entirely with 90 days notice, during which you will be able to spend your remaining balance.

13. Liability

The Service is provided as it is. To the fullest extent permitted by law we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We are not liable for: losses arising from your loss of credentials or recovery codes; assets sent to an expired address, on an incorrect network, or without a required memo; a merchant's refusal to accept a card; movements in the value of a crypto asset before a deposit is credited; or interruption caused by a card network, a payment provider or a blockchain.

Where we are liable, our total aggregate liability is limited to the greater of the fees you paid us in the 12 months preceding the event, or $100. We do not exclude liability for fraud, for death or personal injury caused by negligence, or for anything that cannot lawfully be excluded.

14. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which CryptoCard is established, without regard to conflict-of-law rules, and without depriving you of the protection of mandatory consumer law in your country of residence.

Before starting formal proceedings, raise the matter from the account it concerns. We aim to answer substantively within 30 days. Most disputes are a misunderstanding about a fee, a decline or a deposit, and are resolved at this stage.

If these Terms conflict with the Privacy Policy or the AML & Sanctions Policy on a matter those documents address, those documents prevail on that matter.

15. Reaching us

We do not publish a support mailbox, and that follows from the design rather than from indifference. Your account is the only identifier we hold for you. A message arriving from an address we cannot tie to an account tells us nothing we are able to act on, and answering it would mean guessing which account it concerns.

So anything about an account — a fee, a decline, a deposit, a security concern, a legal notice — is raised from that account, where we can see what you are describing.
